The terms and conditions outlined below (“Terms of Use”) govern your use and our provision of the Website and the Services. By accessing the Website, you agree to be bound by the Terms of Use.

1. Agreement between You and SkyRent

2. Website and Services
The Services allows users to connect with landlords in order rent properties advertised on the Website. Users will be able to view advertised rental listings without creating an account. Users will, however, be required to create an account in order contact a landlord, schedule viewings, and ultimately rent a property advertised on the Website.
By accessing and registering on the Website, SkyRent grants you a non-exclusive, non-transferable limited license to use the Website in accordance with the Terms of Use. You acknowledge and agree that the form and content of the Website and the Services may be altered, modified, or changed from time to time, in our sole discretion, without advance notice to you. You further acknowledge and agree that we may stop providing the Services, at our sole discretion, without any advance notice to you.
In using the Website and the Services, you agree that you will not:

You acknowledge and agree that SkyRent is not a party to any agreement that may be entered into between a user and landlord in respect of an advertised rental property. Other than as stated in the Terms and Conditions or the SkyRent Privacy Policy, you acknowledge and agree that we do not have any fiduciary duty to you solely by your use of the Website and we do not provide any advice or recommendation on any basis, including but not limited to accounting, financial, legal or tax, in respect of the Services.
The Services are provided on an “as is” and “as available” basis. SkyRent disclaims all conditions, representations and warranties not expressly set out in the Terms of Use. SkyRent shall not be liable to you for any loss or damage (whether such loss or damage be direct or indirect, incidental, special or consequential) arising from your use or inability to use the Website or the Services, or an error, omission, interruption in service, computer virus, system failure, loss of data or otherwise, even if SkyRent was advised of the possibility of such loss or damage, nor shall we be held liable for any delay or failure in performance resulting from causes beyond our control.
SkyRent does not guarantee or warrant the conduct of any user of the Website or any landlord with whom you may come into contact with through using the Services. You are advised to take reasonable precautions in your interactions with landlords advertising rental properties on the Website.
These disclaimers and limitations of liability provisions do not affect your rights as a consumer or purport to limit liability that cannot be excluded under the applicable laws of the jurisdiction in which you reside.
4. User Account – Password and Security
You will be required to register on the Website and create a user account in order to use the Services. You agree to provide SkyRent with accurate, current and complete information, which will include personal information about you. For further details of the type of information that will be required, see section 5. Privacy and Personal Information. You may update the information contained in your account at any time. You are not permitted to provide any unauthorized person with access to your account.
You are responsible for taking reasonable steps to ensure that you maintain the confidentiality of your account user ID and password, and also responsible for all activities under your account. You agree to notify us promptly of any unauthorized use of your user ID, password or other account information, or of any other breach of security that you become aware of involving your account or the Services. SkyRent has been provided with the information regarding the rental properties displayed on the Website by the landlords of such properties and believe such information to be accurate. We do not warrant or guarantee the information and recommend that you verify the information related to any property you wish to rent prior to entering into any rental agreement.

Our Website may contain certain hyperlinks that will direct you away from the Website to a third-party website. SkyRent does not control such third-party websites and we are not responsible for the contents of any such websites or any hyperlink contained in such websites. Third party hyperlinks are provided for your convenience, and the inclusion of such hyperlinks does not imply a recommendation or endorsement by SkyRent of such website or any underlying product or service that may be offered. You acknowledge that by accessing a third-party hyperlink on the Website, you do so entirely at your own risk and you agree that SkyRent will not be responsible or directly or indirectly liable for any resulting damage or loss that is caused or alleged to be caused by, or in connection with, your use of a third-party website.

The contents of the Website may include, but is not limited to, information in respect of properties to rent and corresponding data, software applications and tools, images, photographs, audio and/or video content and graphics contained therein or otherwise made available to you in connection with the Services (“Contents”).
The Website, together with all trademarks and other intellectual property that may be displayed, distributed, or otherwise made available via the Website, is the exclusive property of SkyRent. Unless otherwise agreed to, nothing in these Terms of Use should be considered as granting you, directly or indirectly, a right or license, to use any of the Contents, our trademarks, copyrighted materials, logos, trademarks or other intellectual property used on or in connection with the Website or the Services. SkyRent will investigate all disputes between users and Landlords, in respect of the Services, that are brought to our attention. You are responsible for advising us of any concerns or complaints relating to your interactions with a landlord and we will endeavor to investigate and review any concerns and complaints you may have within a reasonable period of time.
13. General
The Terms of Use, including the Privacy Policy, constitute the entire agreement between you and SkyRent relating to your use and our provision of the Website and the Services. You acknowledge and agree that we may provide you with notice, including those regarding changes to the Terms of Use, by email, regular mail, or postings on the Website.
You further acknowledge and agree that if we do not exercise or enforce a legal right or remedy that is contained in these Terms of Use, that such non-exercise or enforcement of such right or remedy should not be taken as a formal waiver of our ability to so exercise or enforce such legal right and that such right or remedy remains available to SkyRent.
If any provision of these Terms of Use is determined to be unenforceable, this will not affect any other provision of the Terms of Use and the offending provision will be deemed amended to the extent necessary to make such provision enforceable.

The laws of the Province of Ontario and any applicable laws of Canada shall govern these Terms of Use, in all respects, and shall govern any disputes arising from the Services. You expressly consent to the exclusive forum, jurisdiction, and venue of the courts of Ontario and/or the applicable federal court of Canada to settle any dispute that may arise.
If you are dissatisfied with this website, you do not agree with any part of these terms or have any other dispute or claim with or against us, any third-party provider or any user of the site with respect to these terms or the website, then your sole and exclusive remedy against us is to discontinue using this website.
